Does Kingspoint have a mandatory HOA?
A: No. The Kingspoint Development does NOT have a mandatory HOA. However, there is a community organization which acts more as a social club for the neighborhood. The Kingspoint Club (the Club), through membership dues, maintains community properties and hosts social events throughout the year. The Kingspoint Club maintains common areas including the clubhouse, pool, deck and porch, playground, park, sports field, dock, boat launch, and boat rack storage facilities. All of the amenities are here for the use and enjoyment of Club members. Throughout the years, many members have volunteered their time and money to maintain these amenities.
Do the Kingspoint Club’s amenities affect the entire neighborhood?
A: Yes, positively. When a Kingspoint home goes up for sale, interested buyers will always see images of the Club’s amenities included in the photos. The Club’s amenities increase the property value of every home in the neighborhood. The more homeowners who join the Club, the more resources we have to care for these amenities and the more vibrant our community becomes.
Does Kingspoint have a mandatory architectural review committee (ARC) requiring approval for home changes, sheds, or building projects?
A: No. Kingspoint does NOT have a mandatory HOA; consequently it does NOT have a mandatory ARC requiring approval of projects. However, Kingspoint is zoned R-1 and falls under the permit requirements and residential regulations of James City County (JCC). To avoid any fines or other actions, we suggest Kingspoint homeowners contact JCC before starting any project to get any needed approvals or permits and avoid possible fines or other County penalties.
The Kingspoint Club is registered in Virginia as a stock corporation. What does this mean?
A: When homeowners become Kingspoint Club members, they purchase one share of common stock in the Club. You may hear this referred to as paying the initiation fee. A share of common stock gives its shareholder “membership” in the Club and one vote at the annual meeting in January. This share of stock is not an investment purchase.
Stock issued by the Kingspoint Club is solely a mechanism for membership under the Virginia Stock Corporation Act (§13.1-624 et seq.) and has no investment value, resale value, or dividend-producing capacity.
As a shareholder in the Kingspoint Club, am I liable for Club debt?
A: No. A key feature of a stock corporation is that shareholders are not personally liable for the company's debts or obligations, meaning their personal assets are protected. Common stock is a type of equity security, meaning it represents membership in a company rather than a debt obligation.
What are the Kingspoint Club annual membership fees used for?
A: Annual membership dues are yearly dues used to fund the the Club’s operations (pool, clubhouse, dock, insurance, maintenance, etc.). These dues must be paid every year to remain active and stay in good standing with the Kingspoint Club.
Does Kingspoint have a 2nd neighborhood organization?
A: Yes. The Kingspoint Neighborhood Association (KPNA) is a volunteer civic association organized to serve all individuals residing within Kingspoint. The KPNA is an inclusive organization designed to promote and foster a healthy, open, and welcoming community by connecting neighbors and promoting civic involvement. The KPNA:
Publishes the Kingspoint Neighborhood Directory annually.
Maintains the front entrance of the neighborhood.
Maintains the structural integrity of neighborhood messaging kiosks.
Communicates with VDOT and other government agencies.
Facilitates communication among residents and the larger community.
Maintains our distinctive street signs.
Provides for the beautification of the neighborhood.
Provides emergency preparedness information.
Is membership in the Kingspoint Club mandatory?
A: No. All Kingspoint homeowners may elect to join the Club as Resident members and pay annual dues to maintain membership in good standing. Likewise, if you are renting within the neighborhood, you may join as a Kingspoint Renter and pay dues each year like other memberships. Are there different types of memberships for the Kingspoint Club?
A: Yes. There are three types of membership to the Kingspoint Club.
“Resident” Memberships: A Kingspoint homeowner can become a Resident Member by filling out the appropriate paperwork, paying an initiation fee of $500, and paying the annual dues payment. This membership gives the homeowner a vote at the annual meeting in January and does not transfer to the next homeowner.
“Kingspoint Renter” Memberships: There is the Kingspoint Renter membership for those who are renting a home that is not in membership under the owner. A Kingspoint Renter membership enables the renter to join Club, use all of the Club’s facilities, and attend all of the social events at the clubhouse. The Kingspoint Renter member may not vote at the annual meeting in January. This membership is non-transferrable.
“Summer Pass Holder” Memberships: Neighbors who live outside the Kingspoint neighborhood may join annually (from Memorial Day through Labor Day each year) as Non-Resident Members. They will have access to the pool, playground, the recreational green space, and the picnic area; they will receive reduced clubhouse rental fees; and invitations to all summer events at the clubhouse.
If I live in Kingspoint and want to rent the Clubhouse am I able to do so?
A: Yes. If you live in the Kingspoint neighborhood and you are a member of the Club, you may rent the Clubhouse at the member rental rate. If you live in the neighborhood and you are not a member of the Club, you may rent the Clubhouse at the non-member rental rate.
Is the Clubhouse available to rent if I don’t live in Kingspoint?
A: Yes. The Clubhouse is available to rent for Non-Residents of Kingspoint.
Can anyone fish on the dock?
A: No. You need to be a member of the Club. However, the responsibility to ensure you have the appropriate fishing license lies with the individual angler, who must obtain the correct license for their age, residency, and type of fishing, and have it on their person while fishing. Please check out the Virginia Department of Wildlife Resources website for fishing license information.
If I am not a member can I walk down to the dock, use the fields, or have my kids play on the playground?
A: No. All facilities and amenities in the Club’s ownership are for members only. Non-members are not permitted to be in those areas. However, if you join the Club, you will have access to all of the Kingspoint Club’s amenities
Am I able to rent a slip at the boat rack storage if I don’t live in the neighborhood?
A: No. Boat rack rentals are available to Resident members only.
Can a non-member living in Kingspoint join the Club?
A: Yes. A non-member household is welcome to join the Club at any time!
Does the Kingspoint Club open its doors to non-members living in the neighborhood?
A: Yes. At least, once a year, the Club invites all neighbors, regardless of membership, to participate in the Memorial Day Cook-out.
If I join the Club at a later time in the year, can I pro-rate my dues?
A: Yes. We will pro-rate the dues if you join the Club after the pool has closed for the Summer in September. You can reach our Membership Chair at membershipkingspoint@gmail.com if you have further questions.
